Kano State High Court has issued an order mandating the Kano State Attorney General, Musa Abdullahi Lawan, to immediately file charges against Alhassan Ado Doguwa, Majority Leader of the Federal House of Representatives, and his co-conspirators over the alleged killing of a resident in the state.
This comes after a retired Chief Magistrate in Kano, Muntari Garba Dandago, filed an application for an order of mandamus, which is a judicial writ issued as a command to an inferior court or ordering a person to perform a public or statutory duty.
The Court gave the order upon an ex parte application by Counsel to the Applicant, Y.I Shariff, which contained 19 paragraphs of affidavit in support, duly sworn to by the applicant himself and dated April 5, 2023.
The written address was filed by the applicant’s counsel on April 10, 2023.
Delivering a ruling on the motion, Justice Maryam Sabo upheld that the Attorney General must exercise his power under section 211 of the Constitution of Federal Republic of Nigeria (as amended) to immediately file a charge against Doguwa and his conspirators for the offences of criminal conspiracy, culpable homicide, mischief, incitement of public disturbance, and possession of firearms before a court of competent jurisdiction.
The Court adjourned the case to May 12, 2023, for the hearing of the motion on notice.
However, when contacted for comment, the state’s Attorney General stated that the state Ministry for Justice was still waiting for Nigeria Police to complete their investigation and bring back the case file.
He also added that the Police had written to the Ministry officials, indicating that the Inspector-General of Police had taken over the investigation and assigned a special team, headed by an Assistant Inspector-General of Police from the Headquarters, to conduct the investigation over the incident.
