Femi Falana, a renowned human rights lawyer, has supported the decision of a Rivers High Court to suspend 25 members of the Rivers State House of Assembly who defected from the Peoples Democratic Party (PDP) to the All Progressives Congress (APC). The court has restrained these members, who are loyal to FCT Minister Nyesom Wike, from parading themselves as lawmakers until the hearing on May 29.

In an interview with ChannelsTV, Falana emphasized that the defected lawmakers have lost their seats and their rights to remain members of the assembly. He cited a previous Supreme Court case that established that a legislator cannot decamp and still retain their membership unless there is a division within their party. Falana argued that the PDP is currently united, therefore the defectors have forfeited their positions.

A fresh crisis emerged in the Rivers State Assembly when some lawmakers elected Victor Oko-Jumbo as the speaker. Oko-Jumbo, representing the Bonny constituency, was elected by lawmakers loyal to Governor Fubara. However, the exact number of lawmakers who supported his election remains unclear.

Falana further explained that a quorum is required for the assembly to conduct proceedings and make decisions. The constitution defines a quorum, and without it, the house cannot carry out its business. Additionally, if the lawmakers intend to remove the governor through impeachment, they must have a two-thirds majority in the legislature.

With Falana’s support for the court’s decision, the fate of the 25 defected lawmakers remains uncertain, pending the hearing on May 29.
