The ongoing legal battle between the Economic and Financial Crimes Commission (EFCC) and Yahaya Bello, the former governor of Kogi State, takes another turn as the appeal court in Abuja hears arguments regarding Bello’s arrest. The EFCC is seeking to prosecute Bello on charges of corruption, including money laundering, breach of trust, and misappropriation of funds totaling N80.2bn. The case has seen several twists and turns.

A lower court in Kogi had previously issued an order blocking Bello’s arrest pending the determination of his fundamental human rights suit.

However, the EFCC approached the federal high court in Abuja to obtain an arrest warrant while the Kogi court was delivering its judgment.

Last week, the EFCC attempted to arrest Bello at his Abuja home, but the attempt failed. This led to the adjournment of his arraignment, which was scheduled for the following day.

Bello’s legal team argued that it was inappropriate for the EFCC to apply for an arrest warrant when the matter was already before the appeal court.

In its appeal, the EFCC is seeking a stay of execution to the order of the trial court in Kogi state, arguing that the order obstructs its statutory functions and duties as specified in the EFCC Act.

The agency contends that it has the authority to investigate and prosecute economic crimes. The outcome of the appeal will determine whether the EFCC can proceed with its case against Bello.
