The Economic and Financial Crimes Commission (EFCC) is seeking to permanently seize various assets belonging to Patience Alison-Madueke, a former petroleum minister during President Goodluck Jonathan’s administration.
On Monday, a suit was filed by her lawyer Mike Ozekhome to extend the time frame for the ex-minister to apply to the court for the setting aside of EFCC’s public notice issued with respect to a public sale of all seized assets due to begin on January 9th this year.
In an originating motion dated and filed January 6th, Alison-Madueke requested five orders from the court, arguing that the various orders were made without jurisdiction and ought be set aside.
She further noted that she had not been given fair hearing in all proceedings leading up to these orders, which allegedly violated her constitutional right to fair hearing as stipulated by section 36(1) of 1999’s act as altered.
Rufai Zaki, a detective with EFFC and member of the team investigating charges of criminal conspiracy, official corruption and money laundering against Alison-Madueke filed a counter affidavit urging dismissal of her application.
He cited proof that charge no FHC/ABJ/CR/208/2018 has been brought against her before court.
Additionally, Zaki argued that in most cases documents calling for forfeiture had already been heard in various courts resulting in final orders being made despite non disclosure or suppression of explicit material facts.
