Dele Alake, a spokesperson for the Media and Communications department at the PCC, held a press conference in Abuja on Friday where he commented on the transmission of election results.
Alake stated that INEC has discretion over such transmissions and that there is no mandatory provision in the 2022 Electoral Act regarding electronic transmission of results.
He pointed out that Section 38 of the Act, which was cited by the PDP and LP as grounds to challenge the February 25 presidential election result, has no connection with result transmission.
Rather, transmission falls under Section 60(2) of the Act and it is at INEC’s discretion.
Alake asserted that transmitting results from polling units in real-time or days later cannot change announced results since what’s important is vote counting with party agents present and voters’ understanding.
He called absurd any claim that uploading time variations could alter figures.
The press conference was held to respond to statements made by Atiku Abubakar (PDP candidate) and Peter Obi (LP candidate).
Mr Alake welcomed their decision to pursue legal action regarding their claims against election results but criticized their initial calls for anarchy as ill-advised.
Despite attempts by Atiku and Obi to discredit BVAS’ credibility, Mr Alake contended that accreditations across Nigeria including theirs were conducted through BVAS, further adding its use improved electoral processes thus stakeholder focus should be on its positive impacts instead of discrediting elections.
